Terms of service

The service is provided by Alient, Inc., a Delaware corporation, doing business as "Ontfly" ("Ontfly," "we," "us"), with a registered office at c/o Corporation Service Company, 251 Little Falls Drive, Wilmington, Delaware 19808. You can reach our legal team at legal@ontfly.ai.

Ontfly is an AI-driven operations platform for small and one-person businesses. From a short brief it generates and deploys a website, provisions a custom domain, creates and runs paid ad campaigns, processes payments through Stripe Connect, and assists with ongoing operations. You connect your own accounts; Ontfly executes actions on them under your direction. Ontfly does not own your generated business, your customers, your customer data, your payments, or the third-party accounts you connect.

You must be 18 or older and able to form a binding contract. You are responsible for keeping your Ontfly credentials and every connected account secure, and for all activity under your account. We use Better Auth (self-hosted) for authentication, with optional Google sign-in. Rate and capacity limits apply (for example, on the free tier: 5 chat messages per minute, 3 active previews, and 50 one-time free credits); we may adjust limits to protect the service.

Paid plans are Pro ($25–$200/month, depending on the monthly credit step you choose) and Business ($79/month); each grants a monthly credit allowance, and unused plan credits roll over up to 2× the monthly grant. Credit packs are sold at $15 (200), $30 (500), and $99 (2000) list price, less a 10% (Pro) or 20% (Business) tier discount; pack credits never expire. Fees on money-movement: ad spend carries a 10% platform fee, and customer revenue you process through your connected Stripe account is subject to a 10% platform application fee taken at transaction time. Domain purchases are passed through at cost plus $1. Fees are exclusive of taxes, which you are responsible for. Unused pack credits are refundable on cancellation; subscription and consumed-credit fees are non-refundable except where required by law.

You will not use Ontfly to advertise, sell, or distribute: crypto or get-rich-quick schemes; supplements or products with unsupported health claims; gambling; weapons; illegal or regulated substances; adult content; content that infringes others' rights; or anything prohibited by Meta's advertising policies or applicable law. You also will not attempt to bypass our safety controls, abuse rate limits, or use the agent to attack or defraud third parties. Ad copy is screened by both a keyword classifier and an LLM judge before submission; repeated or serious violations trigger suspension via our kill switch (§17).

As between you and us, you own the inputs you provide (briefs, brand assets, copy) and, to the extent permitted by law, you own the outputs the platform generates for you — site source, content, images, and video creatives — once generated for your account. We retain ownership of the Ontfly platform, agent, templates, and underlying technology, and grant you a license to use them while your account is active. AI output may be inaccurate, outdated, generic, or unintentionally similar to other works; it is provided for your review, and you are the final reviewer and publisher of anything that goes live under your name. You grant us the limited license to your inputs and outputs needed to operate the service for you.

When you enable advertising, you authorize Ontfly to create, launch, edit, pause, and manage paid ad campaigns on Meta on your behalf and to spend your ad budget up to the limits you set. You remain responsible for funding the underlying ad account. You set and can change budgets at any time, and our kill switch (§17) lets you or us halt all spend immediately. You are solely responsible for the legality and accuracy of your ad content and offers and for compliance with Meta's policies and all applicable advertising, consumer-protection, and disclosure laws. The 10% platform fee in §4 applies to ad spend. We do not guarantee any ad performance, delivery, reach, conversion, or return on spend; ad outcomes depend on Meta, your market, and your offer.

Ontfly is an autonomous agent that takes actions inside the accounts you connect — Stripe Connect, Meta ad accounts and Pixels, your domain registrar, and any email or other integrations you link. By connecting an account you delegate Ontfly to act as your agent within the scope of access you grant, to perform tasks such as deploying sites, configuring payments and payouts, launching campaigns, and managing domains and DNS. This authority is limited to what is needed to operate your business and to the scopes you approve; we do not use it for any other purpose. We store the associated tokens and credentials encrypted and scoped to the minimum required, and we record an audit-log entry attributing every state-changing action to you, the agent, the system, or an admin. You may revoke access at any time by disconnecting an account in the dashboard or revoking access at the provider; revocation stops future agent actions for that account. Actions the agent takes under your direction are attributable to you as principal, except to the extent they result from our gross negligence or willful misconduct.

For your first 30 days, every new ad-account launch and other high-impact actions are reviewed by our team before going live. After that you can mark patterns auto-approved, and you can require manual approval again at any time. We reserve the right to escalate any action to manual review regardless of account age, and to decline actions that violate these Terms or third-party policies. The audit log gives you a record of what the agent did and when.

Images and video creatives are produced with third-party generative models (currently Fal.ai) and text with our LLM providers (currently DeepSeek and OpenRouter-routed models). You are responsible for ensuring you hold the rights to any inputs you provide — logos, brand assets, photos, names, and likenesses — and for not requesting content that infringes intellectual property, depicts real people without consent, or is otherwise prohibited under §5. Generated media is provided without warranty of originality, accuracy, or fitness, is subject to the third-party model providers' own terms, and must be reviewed by you before publication.

You own your data. Site source is exportable as a Next.js project, content as Markdown, your customer list as CSV, and automations as JSON. Domains can be transferred to any other registrar at any time. We delete your account data within 30 days of cancellation, except records we must retain for legal, tax, or accounting purposes. Our handling of personal data is described in the Privacy policy.

Ontfly relies on third-party services including Stripe, Meta, Cloudflare, Vercel, Render, Neon, Fal.ai, DeepSeek/OpenRouter, Brave, Postmark, and Sentry (see /legal/subprocessors). If those services are unavailable or change their terms, dependent features may degrade or stop. We do not promise any specific uptime unless agreed in a separate written SLA, and we post incidents to our status page.

The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding AI output, ad performance, or business results. You are the final reviewer of everything published or transacted on your behalf. We do not warrant that the service will be uninterrupted, secure, or error-free.

You will defend, indemnify, and hold harmless Ontfly and its personnel from any third-party claims, damages, losses, and costs (including reasonable legal fees) arising out of: your content, offers, or ads; your products or customer relationships; your use of the agent and connected accounts; your violation of these Terms, third-party platform policies, or applicable law; or the rights you asserted in inputs you provided. We will give you prompt notice of any such claim and reasonable cooperation.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill — including lost ad spend or business results. Our aggregate liability is capped at the greater of $100 or the fees you paid us in the 12 months before the claim, except for our gross negligence or willful misconduct. Ontfly is not liable for the acts of Meta, Stripe, or other providers, or for the consequences of actions the agent took under your authorization and within scope.

Either party may terminate at any time. We may suspend or terminate your account for violations of these Terms, non-payment, or risk to the platform or third parties, including via the kill switch in §17. On termination, the agent stops acting in your connected accounts, your license to the platform ends, and the data and refund provisions in §4 and §11 apply.

To protect you, third parties, and the platform, we may immediately pause ad spend, halt agent actions, and suspend access using our kill switch when we detect policy violations, fraud, runaway spend, or security risk. You can also trigger it yourself to stop all automated activity at once.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Before filing anything, the parties will attempt in good faith to resolve any dispute informally by contacting legal@ontfly.ai. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Delaware, and each party irrevocably consents to the personal jurisdiction and venue of those courts; there is no arbitration. To the fullest extent permitted by law, each party waives any right to a jury trial and agrees that disputes will be resolved on an individual basis only: each party waives any right to participate in a class, collective, or representative action, and the courts may not consolidate more than one person's claims.

We may update these Terms as the product evolves. For material changes we will update the date above and notify account holders by email at least 30 days before the change takes effect. Continued use after the effective date constitutes acceptance.

These Terms, together with the Privacy policy and any order you accept, are the entire agreement between us. If a provision is held unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor in connection with a merger or acquisition. The disclaimers, liability limits, indemnities, and ownership terms survive termination.
